Sexual harrassment

Refers to committing a sexual action, which offends the right to sexual self-determination. This action is punishable unless no other sentence has been set out for it.

Forcing into a sexual act

It is a case of forcing into a sexual act, if the offender forces, by means of violence or threats, another person into a sexual act other than penetration or forces another to be oppressed into another sexual act and it significantly violates the other persons right to sexual self-determination or the offender has taken the person’s helpless condition for granted.

Rape

Rape is an act, where another person is forced in to sexual intercourse by means of violence or threats. A person is also charged with rape, if he/she takes for granted the fact that the other person is unable to defend him-/herself or form or express his/her will due to unconsiousness, illness, disability, fear or other state of helplessness, and is in sexual intercourse with this person.

Aggravated rape is when the offender causes the victim a serious bodily injury, a serious illness or a life-threatening state, causes significant mental or physical suffering, the crime is done in a particularly brutal, cruel or humiliating manner, a life-threatening weapon is used or threats are made otherwise with serious violence, or the victim is a child under the age of eighteen years.

Attempted rape is punishable.

Sexual abuse

If the offender uses his/her position or age for granted to persuade a person under the age of 18 years, who is under the control of the offender, in to sexual intercourse or other sexual act, it is a case of sexual exploitation. If a person, who is unconcious due to being intoxicated, ill, disabled or otherwise helpless, is sexually abused.

Sexual abuse of children

If sexual intercourse or any other sexual act is carried out with a person under the age of 16 years, it is a case of child sexual abuse, unless the partner is approximately the same age. It is also a case of child sexual abuse, if the child’s parent or other person comparable to the parent exploits a 16-17-year-old child, who lives in the same household.

Aggravated sexual abuse of children

It is a case of aggravated sexual abuse of children if the offender is in sexual intercourse with a child under the age of 16 years or the child is under 18 and the offender is a parent or other person comparable to a parent and lives in the same household with the child. It is also a case of aggravated sexual abuse, if the victim is a child and the crime causes particular harm due to the age or level of development of the child, the crime is done in a particularly humiliating manner or the crime causes particular harm to the child due to the particular trust towards the offender or due to any other position of dependance.

Buying sexual services from a young person

It is a case of buying sexual services from a young person, if you promise or provide compensation to a person under 18 for having sexual intercourse or carrying out any other sexual act.

Persuading a child for sexual purposes

It is a case of persuading a child for sexual purposes if the offender suggests meeting with the child in order to take photos or recordings, where the child’s sexual morality is violated or the purpose is to sexually abuse the child or buy sexual services from a person, who is under 18 years of age.

Watching a presentation of the violation of a child’s sexual morality

It is a case of watching a presentation of the violation of a child’s sexual morality, if the offender watches an arranged presentation, in which a child under the age of 18 is presented in a way that violates his/her sexual morality.
